Agreement to Terms

Welcome to VizGolf. These Terms of Service ("Terms") govern your use of the VizGolf website and services (collectively, the "Service") operated by Arnold Kim ("we," "us," or "our").

By accessing or using VizGolf, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Account Terms

Account Creation

• You must be at least 13 years old to use VizGolf
• You must provide a valid email address and create a unique username
• You are responsible for maintaining the security of your account and password
• You must notify us immediately of any unauthorized use of your account
• One person or entity may not maintain more than one free account

Your Responsibilities

You are responsible for:

• All content posted under your account
• All activity that occurs under your account
• Keeping your login credentials confidential
• Ensuring your account information is accurate and up to date

Acceptable Use

You agree not to use VizGolf to:

• Violate any laws or regulations
• Harass, abuse, or harm other users
• Submit false, inaccurate, or misleading information
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scrapers) without permission
• Impersonate any person or entity
• Upload viruses or malicious code
• Spam other users or submit unsolicited content
• Sell or transfer your account to another person

User-Generated Content

Your Content

"Your Content" means any information, data, text, or other materials you submit to VizGolf, including:

• Golf scorecards and statistics
• Photos and videos
• Equipment information
• Course submissions
• Profile information
• Messages sent through contact forms

Content Ownership

You retain all rights to Your Content. By submitting content to VizGolf, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store, display, and process Your Content to provide the Service
• Display Your Content in community features (if you opt in to public profile)
• Use aggregated, anonymized data for analytics and improvements

Content Standards

Your Content must not:

• Contain false or misleading information
• Infringe on others' intellectual property rights
• Contain offensive, abusive, or inappropriate material
• Violate others' privacy or publicity rights

Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.

Service Availability

We strive to keep VizGolf available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Factors beyond our reasonable control

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be error-free or uninterrupted
• Warranties regarding the accuracy or reliability of information
• Warranties that defects will be corrected

Handicap Calculations: While we strive for accuracy in handicap calculations, we make no warranty that they are official USGA handicaps or suitable for tournament play. Always verify with your golf club or official handicap service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIZGOLF AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Damages arising from your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER).

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless VizGolf, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any Content you submit to the Service

Termination

By You

You may stop using VizGolf at any time. To delete your account and data, contact us at [email protected].

By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Abusive or fraudulent behavior
• Extended periods of inactivity
• Legal or regulatory requirements

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data, though we may retain certain information as required by law or for legitimate business purposes.

Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by VizGolf and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission. You may not:

• Copy, modify, or distribute the Service or its content
• Reverse engineer or attempt to extract source code
• Remove copyright or proprietary notices

Third-Party Services

VizGolf may contain links to third-party websites or services (such as golf course APIs) that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party content or services.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

• Sending email notification for significant changes

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
